1. Overview
This website and online store are operated by **Rikardo Stoilov**, doing business as **VISTINA** ("VISTINA," "we," "us," or "our"). Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer and sell our products.
These Terms of Service (the "Terms") govern your access to and use of **vistina.ch** (the "Site") and any purchase you make through the Site. By accessing the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the Site or place an order.
These Terms incorporate our Returns & Refunds Policy, Shipping Policy, Privacy Policy, and any other policies expressly referenced here or made available during checkout.

3. Eligibility
You must be at least the age of majority in your state of residence to place an order. If you are under the age of majority, an order may be placed only with the involvement and consent of a parent or legal guardian.
The Site is not directed to children under 13, and children under 13 may not create an account, submit personal information, or place an order.
By placing an order, you represent that the information you provide is accurate, that you are authorized to use the selected payment method, and that you are legally capable of entering into the purchase.
4. Products and made-to-order production
VISTINA sells made-to-order apparel and related products. Products are generally manufactured or printed only after an order is placed. Our products may be fulfilled and shipped by third-party fulfillment providers, including Printful, from different facilities.
We make reasonable efforts to display product descriptions, photographs, colors, measurements, and other details accurately. However:
- Colors may appear differently depending on your screen and device settings.
- Product measurements may have reasonable manufacturing tolerances.
- Print placement, texture, and appearance may vary slightly between individual items.
- Product packaging and fulfillment location may vary.
These normal variations do not necessarily constitute a defect. Please review the product description and size guide before ordering.
We may modify or discontinue products at any time. If a product becomes unavailable after you place an order, we will contact you and offer an appropriate alternative or cancel and refund the affected item.
5. Prices, taxes, and charges
Unless otherwise stated, prices are displayed in U.S. dollars. The price shown on the product page may not include taxes, shipping charges, or other charges that are calculated during checkout.
You will be shown the total amount payable before submitting your order. Applicable sales, use, or similar taxes may be calculated and collected as required by law.
We may change prices at any time, but a price change will not affect an order that we have already accepted. If an obvious pricing or technical error affects an order, we may contact you to confirm the correct price or cancel the affected order and issue a full refund.
Discounts and promotional offers are subject to their stated conditions, availability, and expiration dates. Unless expressly stated otherwise, promotions cannot be combined or applied retroactively.
6. Orders and contract formation
When you submit an order, you are making an offer to purchase the products in your cart under these Terms. An automated order confirmation acknowledges that we received your order; it does not necessarily mean that we have accepted it.
We accept your order when we send an acceptance or shipping confirmation, or when fulfillment begins, whichever occurs first. If payment is collected but we do not accept all or part of your order, we will refund the unaccepted amount to the original payment method.
We may lawfully refuse, limit, or cancel an order when reasonably necessary, including in cases of:
- Product unavailability
- Suspected fraud or unauthorized payment
- Incorrect pricing or product information
- Shipping restrictions
- Suspected resale or abuse of promotions
- Violation of these Terms or applicable law
If we cancel an order after payment, we will refund the canceled amount unless the cancellation results from a confirmed chargeback, fraudulent transaction, or another circumstance in which a refund is not legally owed.
7. Payment
Payment must be made using one of the payment methods offered during checkout. Payment services may be provided by Shopify or other payment processors and may be subject to their own terms and privacy notices.
You authorize us and our payment providers to charge the total amount displayed during checkout. We do not guarantee that every payment method will always be available.
If a payment is declined, reversed, disputed, or identified as unauthorized, we may suspend or cancel the order. You remain responsible for amounts properly owed for products that were lawfully ordered and delivered, subject to your rights under applicable law.
8. Order changes and cancellations
Because products are made to order and fulfillment may begin shortly after purchase, changes and cancellations are not guaranteed.
Contact **info@vistina.ch** immediately if you need to change or cancel an order. We will try to assist, but once production or fulfillment has begun, the order generally cannot be changed or canceled.
If we successfully cancel an order before fulfillment begins, any applicable refund will be issued to the original payment method.
9. Shipping and delivery
We currently ship to eligible addresses within the 50 United States. Available shipping destinations and methods are shown during checkout.
Production and delivery dates are estimates unless we expressly state that a date is guaranteed. Orders may be produced and shipped from different facilities and may arrive in separate packages.
We will have a reasonable basis for any advertised shipping timeframe. If we cannot ship within the promised timeframe, or within the timeframe required by applicable law when no timeframe was stated, we will provide any notice, cancellation option, or refund required by law.
Customers are responsible for providing a complete and accurate shipping address. Additional costs may apply when a package must be reshipped because an address was incorrect or incomplete, or because the package was refused or left unclaimed.

10. Returns, exchanges, defects, and refunds
Because our products are made to order, we generally do not accept returns or exchanges due to an incorrect size or color selection, ordering the wrong product, or a change of mind.
If an item arrives damaged, defective, misprinted, or incorrect, contact **info@vistina.ch** within 30 days of delivery and provide your order number, a description of the issue, and clear photographs.
Do not return an item without receiving instructions from us. The correct return location may depend on where the item was fulfilled and may be different from our Swiss business address.
Eligibility requirements, claim procedures, exclusions, and refund information are described in our Returns & Refunds Policy, which forms part of these Terms. Nothing in these Terms limits rights that cannot be excluded under applicable law.
11. Accounts and account security
If the Site allows customer accounts, you are responsible for keeping your login details confidential and for activity occurring through your account. Notify us promptly if you believe your account or payment information has been used without authorization.
We may suspend or close an account when reasonably necessary to protect customers, prevent fraud, comply with law, or enforce these Terms. Closing an account does not cancel obligations arising from orders already placed.
12. Customer reviews and other content
You may be able to submit reviews, photographs, comments, or other content through the Site or services provided by our review provider, including Sternify.
You retain ownership of content you create. When you voluntarily submit content for publication, you grant VISTINA a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, and distribute that content only as reasonably necessary to operate, promote, and improve the Site and our products. This license does not transfer ownership of your content to us.
You represent that you have the necessary rights to submit the content and that it does not contain unlawful material, confidential personal information, malicious code, or content that infringes another person's rights.
We may moderate or remove content that is fake, unlawful, abusive, obscene, unrelated to the product, deceptive, infringing, or contains sensitive personal information. We will not restrict, penalize, or remove an otherwise lawful review merely because it expresses an honest negative opinion.
13. Intellectual property
The Site and its content—including the VISTINA name, logos, designs, graphics, photographs, videos, text, product artwork, and overall presentation—are owned by or licensed to VISTINA and are protected by applicable intellectual-property laws.
We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Site for personal, non-commercial shopping purposes. You may not reproduce, distribute, modify, sell, license, scrape, exploit, or create derivative works from Site content without our prior written permission, except where applicable law permits it.
14. Prohibited uses
You may not use the Site:
- For unlawful, fraudulent, or deceptive purposes
- To violate intellectual-property, privacy, publicity, or other rights
- To submit false information or impersonate another person
- To transmit malware, malicious code, or harmful automated requests
- To interfere with the Site's operation or security
- To scrape, harvest, or collect data without authorization
- To circumvent purchase limits, security measures, or access restrictions
- To misuse promotions, reviews, payment disputes, returns, or chargebacks
We may restrict access or cancel affected transactions when reasonably necessary to address prohibited conduct, subject to applicable law.
15. Third-party services and links
The Site relies on third-party services, which may include Shopify, payment providers, Printful, Sternify, analytics providers, advertising platforms, and shipping carriers. Third parties may process information or provide services under their own terms and privacy notices.
Links to third-party websites are provided for convenience. We do not control and are not responsible for independent third-party websites or their content, security, availability, or practices.
The use of a fulfillment provider does not by itself make that provider the seller of your VISTINA order. Your purchase contract is with the legal operator identified in Section 2 unless checkout clearly states otherwise.
16. Privacy
Our collection and use of personal information are described in our Privacy Policy. Cookie and advertising choices may also be available through our cookie banner and Your Privacy Choices page.
By using the Site, you acknowledge that internet transmissions and third-party systems cannot be guaranteed to be completely secure. This does not reduce any data-protection duties imposed on us by applicable law.
17. Disclaimer of warranties
To the fullest extent permitted by applicable law, the Site and its digital content are provided on an "as available" basis. We do not guarantee that access to the Site will always be uninterrupted, error-free, or secure.
Products are provided subject to the descriptions and express commitments made on the Site and to any warranties or consumer rights that cannot be excluded. Nothing in these Terms excludes implied warranties or statutory protections where excluding them would be unlawful.
18. Limitation of liability
To the fullest extent permitted by applicable law, VISTINA and its owners, employees, and agents will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from use of the Site or a product, including lost profits or lost data, when such losses were not reasonably foreseeable.
For claims arising from a particular order, our aggregate liability will not exceed the amount you paid for that order, except where a different remedy or amount is required by applicable law.
These limitations do not apply to liability that cannot legally be limited or excluded, including liability arising from fraud, willful misconduct, gross negligence, death or personal injury where applicable, or non-waivable consumer rights.
19. Indemnification for misuse
To the extent permitted by law, you agree to be responsible for reasonable losses and third-party claims caused by your unlawful misuse of the Site, your infringement of another person's rights, or content you submit in violation of Section 12. This section does not apply to ordinary consumer use of the Site or limit any non-waivable rights.
20. Events beyond reasonable control
We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, severe weather, war, civil unrest, labor disruptions, epidemics, governmental action, carrier interruptions, utility failures, internet outages, or supply-chain disruptions.
This section does not remove any right to cancellation, notice, replacement, or refund that applicable law requires.
21. Governing law and disputes
These Terms and contracts with VISTINA are governed by the substantive laws of Switzerland, without regard to conflict-of-law principles, except to the extent that mandatory laws of the customer's state or country apply and cannot be waived by contract.
Before beginning formal proceedings, we encourage you to contact **info@vistina.ch** so that we can try to resolve the issue directly.
Nothing in these Terms requires a consumer to give up a court, venue, remedy, or protection that cannot legally be waived. We do not impose mandatory arbitration or a class-action waiver through these Terms.
22. Changes to these Terms
We may update these Terms to reflect changes to our business, services, or legal obligations. The updated version will be posted on this page with a revised "Last updated" date.
Changes apply prospectively from the date they are posted and will not retroactively change the material terms governing an order already accepted, unless required by law or expressly agreed with you.
23. Severability, waiver, and assignment
If a provision of these Terms is found unlawful or unenforceable, it will be enforced to the maximum extent permitted or severed, and the remaining provisions will continue in effect.
Our failure to enforce a provision is not a waiver of that provision. You may not assign your rights or obligations under these Terms without our consent. We may assign our rights and obligations in connection with a merger, reorganization, sale of the business, or transfer to an affiliated entity, subject to applicable law.
24. Entire agreement
These Terms and the policies incorporated into them constitute the entire agreement between you and VISTINA concerning your use of the Site and purchases from us, except for additional terms expressly presented and accepted during a particular transaction.
